Terms of Service

These Terms take effect on the date Josie is first made available to the public, which is recorded when this version is published.

1. About these terms and who we are

These Terms of Service (“Terms”) govern your use of the Josie mobile app (“Josie”, the “app”). Josie is provided by Health Surfers BV, a company incorporated in Belgium, enterprise number BE 1039.918.687, registered office Blauwhuisstraat 31, 8531 Hulste (Harelbeke), Belgium (“we”, “us”, “our”).

Please read these Terms together with our Privacy Policy, which explains how we handle your personal data and forms part of your agreement with us.

2. Acceptance and eligibility

By creating an account or using Josie, you agree to these Terms. If you do not agree, do not use the app.

Josie is intended for adults. You must be at least 18 years old to create an account or use the app. We ask your age at onboarding and do not permit use by anyone under 18.

3. What Josie is

Josie is a self-tracking and education app for people managing PMOS (formerly known as PCOS). It lets you record your own health information, learn about PMOS through reviewed educational content, and prepare for and document conversations with your healthcare professionals. It also lets you export and, if you choose, share your own health record in a standard format.

5. Your account

You are responsible for the information you provide, for keeping your login details secure, and for activity under your account. Please give accurate information and keep it up to date. Tell us promptly if you believe your account has been accessed without your permission. One account is for one person; do not share it.

6. Subscriptions, free trial, billing and renewals

Josie offers a free tier and two paid tiers:

  • Plus: €9.99 per month or €94.99 per year
  • Premium: €14.99 per month or €144.99 per year

Paid subscriptions are sold and processed through the Apple App Store or Google Play. Billing, renewals, upgrades and cancellations are managed through your store account, and the store’s terms govern the purchase. Paid subscriptions renew automatically for the same period until you cancel; you can cancel at any time in your store account, and cancellation takes effect at the end of the current billing period.

The 14-day free trial gives you Premium access. It does not require a payment method and does not charge you automatically when it ends. You are charged only if and when you actively choose to subscribe.

Refunds for store purchases are handled by the Apple App Store or Google Play in line with their policies. We do not separately process payments and so cannot ourselves refund a store purchase.

7. Right of withdrawal for consumers

As a consumer in the EU you generally have a 14-day right to withdraw from a distance contract for digital services. Because paid subscriptions are bought through the Apple App Store or Google Play, the store handles the transaction and any withdrawal or refund request is processed by the store under its terms. Nothing in these Terms removes any mandatory statutory right you have as a consumer.

8. Changes to prices and tiers

We may change our prices or what each tier includes. Where a change affects a subscription you already hold, we will give you reasonable notice, and the change will not take effect until your next renewal. If you do not accept a price change, you can cancel before it takes effect.

9. Acceptable use

When using Josie, you agree not to:

  • use the app for any unlawful purpose, or in breach of these Terms;
  • enter another person’s health data, or import or share data you are not entitled to;
  • attempt to access accounts or data that are not yours, or interfere with the security or operation of the app;
  • copy, modify, reverse engineer or attempt to extract the source code of the app, except to the extent the law allows;
  • use the app in a way that could damage, disable or overload it, or use automated means to access it without our permission.

10. Your data and content

The health information and other content you enter remain yours. You grant us the permission we need to host, process and display that content in order to provide the app to you, as described in our Privacy Policy. You are responsible for the accuracy of what you enter.

11. Health data sharing features

Josie lets you export your health record and share it with others, for example by generating an encrypted link for a clinician. These features put you in control: you choose what to include and who to share with. Once you share a file or link, what the recipient does with it is outside our control, so share only with people you trust. We store nothing on our servers for a download, and the key to an encrypted share link travels only inside the link you share.

12. Intellectual property

The app, its design, and its educational content are owned by Health Surfers BV or its licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the app for your own personal, non-commercial use while these Terms are in force. The educational content is general information reviewed for quality; it is not personal medical advice. “Josie” and our logo are our trademarks and may not be used without our permission.

13. App stores and third-party services

You download Josie from, and buy subscriptions through, the Apple App Store or Google Play, and their terms apply in addition to these Terms. Features that connect to Apple Health or Health Connect are subject to those platforms’ terms. We are not responsible for third-party platforms or services we do not control.

14. Availability and changes to the app

We work to keep Josie available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may update, change or withdraw features to improve the app, to keep it secure, or to meet legal and regulatory requirements. Where a change materially reduces the service you pay for, section 8 applies.

15. Disclaimers

Beyond the medical disclaimer in section 4, and to the extent permitted by law, Josie is provided “as is”. We do not warrant that the app will meet every requirement or that the information in it is complete or suitable for your particular circumstances. This does not affect the mandatory rights you have as a consumer under Belgian law, which we do not exclude or limit.

16. Our liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under applicable law, and your mandatory rights as a consumer are unaffected.

Subject to that, we are not liable for loss that was not reasonably foreseeable, for loss arising from your reliance on the app in place of professional medical advice, or for loss caused by third-party platforms or by your sharing of your own data with others. Because Josie does not provide medical advice, diagnosis or treatment, you remain responsible for your own health decisions and for seeking professional care.

17. Suspension and termination

You can stop using Josie and delete your account at any time in the app. We may suspend or end your access if you materially breach these Terms or use the app unlawfully; where it is reasonable to do so, we will tell you first. If your account ends, the sections that by their nature should survive (such as intellectual property, disclaimers, liability and governing law) continue to apply.

18. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the version below and ask you to review and agree again in the app before you continue to use it. If you do not agree to the updated Terms, you can stop using the app and delete your account.

19. Governing law, jurisdiction and disputes

These Terms are governed by Belgian law. As a consumer, you also keep the protection of any mandatory provisions of the law of the country where you live. Disputes may be brought before the competent Belgian courts, without prejudice to any right you have as a consumer to bring proceedings in the courts of your own country of residence.

If you are unhappy with something, please contact us first at privacy@josie.care so we can try to resolve it. Belgian consumers may also refer a dispute to the Consumer Mediation Service (Service de médiation pour le consommateur / Consumentenombudsdienst, consumentenombudsdienst.be).

20. General

  • Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about your use of Josie.
  • Severability. If any part of these Terms is found to be unenforceable, the rest continues to apply.
  • No waiver. If we do not enforce a right straight away, that does not waive it.
  • Assignment. You may not transfer your rights under these Terms; we may transfer ours in connection with a reorganisation or sale of the business, without reducing your rights.
  • Language. The app and these Terms are provided in English at launch.
