2. Accepting these terms
By creating an account or using Josie, you agree to these Terms of Service and our Privacy Notice. If you do not agree, do not use the service.
We may update these terms from time to time. If we make a material change, we will notify you in the app and by email before the change takes effect. Continued use of Josie after the effective date of an update constitutes your acceptance of the revised terms.
3. Eligibility
Josie is intended for adults aged 18 and over. By creating an account, you confirm that you are at least 18 years old. If you become aware that a person under 18 has created an account, please contact us at support@josie.care.
You must provide accurate, current, and complete information when registering. You are responsible for keeping your account details up to date.
4. What Josie is
Josie is a digital health platform classified as a Class I Software as a Medical Device (SaMD) under EU Medical Device Regulation 2017/745. It is designed to help adult women living with or seeking a diagnosis of Polycystic Ovary Syndrome (PCOS) track their health, prepare for medical appointments, and access evidence-based health information.
Josie is not a diagnostic tool. The patterns, insights, and reports generated by Josie are based on the data you enter and are intended to support your conversations with healthcare professionals. They are not clinical assessments, medical diagnoses, or treatment recommendations. Nothing in Josie should be understood as a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.
The Building My Case feature helps you document your health experience in a structured format. Reports generated through this feature are self-reported summaries, not clinical records, and include a disclaimer to that effect.
If you are experiencing a medical emergency, contact your local emergency services immediately.
5. Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Do not share your password with anyone.
If you believe your account has been compromised, contact us immediately at support@josie.care.
We may suspend or close accounts that violate these terms, that we reasonably believe to have been accessed without authorisation, or that have been inactive for an extended period following prior notice.
6. Subscription tiers
Josie offers three access tiers:

Annual plans are billed as a single upfront payment. All prices include applicable taxes where required by law.
A summary of features available at each tier is available at josie.care and within the app. We reserve the right to change pricing with reasonable notice; existing subscribers will be notified before any price change affects their billing.
7. Free trial
Plus and Premium subscriptions include a 14-day free trial. No payment method is required to start a trial. At the end of the trial period, continued access to Plus or Premium features requires starting a paid subscription. If you do not subscribe, your account reverts to the Free tier and paid-tier data remains accessible if you subsequently subscribe.
Only one free trial per person is permitted.
8. Payment and billing
Subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android) using in-app purchase. Billing, payment method management, and receipts are handled by Apple or Google in accordance with their respective terms of service. Health Surfers does not store payment card details.
Subscription entitlements are managed by RevenueCat. RevenueCat receives your purchase token and a pseudonymous user identifier. No health data is shared with RevenueCat.
Subscriptions renew automatically at the end of each billing period unless cancelled. You can manage and cancel your subscription at any time through your Apple ID or Google account settings.
9. Cancellation and refunds
You may cancel your subscription at any time through your device’s app store account settings. Cancellation takes effect at the end of the current billing period; you retain access to your paid tier until then.
Refunds are subject to the refund policy of the app store through which you purchased. Health Surfers does not process refunds directly. To request a refund, use Apple’s or Google’s standard refund process.
Deleting the Josie app does not cancel your subscription. You must cancel through your app store account.
10. Your content and data
You retain ownership of all health data and content you enter into Josie. By using the service, you grant Health Surfers a limited licence to process your data for the purposes set out in the Privacy Notice, including providing and improving the service.
We do not sell your health data to third parties. Data processing is described in full in the Privacy Notice.
You are responsible for the accuracy of the data you enter. Josie provides tools to help you track and organise health information, but we cannot verify the accuracy of user-entered data.
11. Acceptable use
You agree not to:
- Use Josie for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorised access to any part of the service or its infrastructure
- Interfere with or disrupt the integrity or performance of the service
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Use the service to transmit unsolicited communications or malicious code
- Impersonate another person or misrepresent your identity or affiliation
- Use automated means to access the service without our express permission
- Attempt to circumvent subscription entitlements or access controls
12. Intellectual property
Josie, including the app, its content, features, design, and underlying software, is owned by Health Surfers and protected by applicable intellectual property law. Nothing in these terms grants you any ownership right in the service.
The education library content in Josie has been reviewed by our scientific advisory board. You may access and use this content for your personal health management. You may not reproduce, distribute, or commercially exploit it without our written permission.
13. Third-party services and links
Josie integrates with third-party services including Apple HealthKit, Google Health Connect, and app store platforms. Your use of those services is subject to their respective terms and privacy policies. Health Surfers is not responsible for the practices of third-party services.
The app may contain links to external websites or resources for informational purposes. We are not responsible for the content or availability of those external resources.
14. Disclaimer of warranties
Josie is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Health Surfers makes no warranties, express or implied, regarding the service, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
We do not warrant that the service will be error-free, that defects will be corrected, or that the service is free of viruses or other harmful components.
15. Limitation of liability
To the fullest extent permitted by applicable law, Health Surfers and its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
Our total liability to you for any claim arising under these terms will not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.
Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
16. Medical disclaimer
Josie is a health tracking and information tool. It is not a substitute for professional medical care. The insights, patterns, and reports produced by Josie are based on the data you enter and are intended to help you understand and communicate your health experience. They do not constitute a clinical diagnosis or recommendation.
Always consult a qualified healthcare professional before making decisions about your health, medications, or treatment. If you are in a medical emergency, contact your local emergency services immediately.
17. Data protection
Your personal data is processed in accordance with our Privacy Notice. The Privacy Notice explains what data we collect, how we use it, who we share it with, how long we keep it, and your rights as a data subject under the General Data Protection Regulation (GDPR).
18. Governing law and disputes
These terms are governed by the laws of Belgium. Any dispute arising from or relating to these terms or your use of Josie will be subject to the exclusive jurisdiction of the courts of Belgium, unless mandatory consumer protection laws in your country of residence provide otherwise.
If you have a complaint, please contact us first at support@josie.care. We will do our best to resolve it promptly.
19. Changes to the service
We may update, modify, or discontinue features of Josie at any time. We will give reasonable notice of significant changes where possible. We are not liable for any modification, suspension, or discontinuation of the service.
